Naked Ballots In Philly Are About To Become Odd History

I received an email today from one of the Pennsylvania House GOP representatives: Russ Diamond, of Lebanon, PA. This was in response to my most recent article .

According to Russ Diamond:

“there is a legal theory floating around which states that if an election is not conducted according to law or is proven to be ripe with errors or fraud, then the General Assembly could take extraordinary action of ignoring the apparent result of the popular election and appointing presidential electors directly.”

“we have asked the governor for a full audit of the election, and we have asked him to withdraw or vacate any certifications of results in all statewide races in the 2020 General Election.”

the state legislature is “monitoring” some federal cases as well as “exploring” all other avenues – though he did not describe what those avenues are or what they aim to accomplish.

PA State Legislature introduces resolution to dispute the results of PA’s 4 statewide elections.

I don’t know if this has any legal enforceability. However, it serves as a way to legitimize the claims of fraud. That would make it very difficult for electors to claim that they aren’t worried about it. It could inspire some of them to do the right thing.

Trump and his team have been challenging allegations of voter fraud.

Trump knows Pennsylvania is home to a lot of fraud, corruption, and cheating.

I do believe that there are plenty of examples of voter fraud here. In fact, it’s likely that in the next year or two, people will be fined or arrested for some of it. However, in terms of certifying this election and figuring out quickly how to resolve it, I think we can suspend judgment about fraud and still get a resolution.

Errors could be just as bad as fraud in terms of a falsified result.

WE COULDN’T EVEN DO A RECOUNT IN PENNSYLVANIA, AND THAT’S A MAJOR PROBLEM FOR EVERYBODY NOW

Diamond did not mention anything about a recount or audit of the vote, outside of a request of the governor. Calling the election “in dispute” is one thing. Claiming there is fraud is another thing. Alleging errors could be yet another thing. But, in Pennsylvania, electors already have the right to petition for a recount, so long as they believe there is fraud, or errors in the election. They do not have to have any actual evidence to do this either.

So despite the constant cries from politicians and media people that there is no evidence of fraud, which they think invalidates Giuliani or others’ claims, that’s not true. Not in Pennsylvania, at least.

The process of forcing a recount in Pennsylvania is dependent on a petition of (3) electors. That means a recount couldn’t be done until the results were certified, and electors are selected. In in the Pennsylvania General Assembly, it states, “if three qualified electors of the election district shall file, as hereinafter provided, a petition duly verified by them, alleging that upon information which they consider reliable they believe that fraud or error, although not manifest on the general return of votes made therefrom, was committed in the computation of the votes…or in the marking of the ballots, or otherwise in connection with such ballots.”

It costs somewhere between $50 – $100 to file.

Fraud doesn’t even have to be “manifest on the general return of votes.”

That means even with regular election results, electors could demand a recount to ensure that they know what the public really wants. They need to know what the popular vote actually was, before they can vote accordingly.

I DON’T THINK THESE “NAKED BALLOTS” CAN BE CURED, UNFORTUNATELY

They want these naked ballots kept quiet, because they have some secrets to tell.

from both their envelopes and their “secrecy” envelopes, means all mail-in/absentee ballots are naked now. That means there is no way to audit those votes. A full audit of these votes would ensure that the ballot was placed in the secrecy envelope, and the mail envelope, at least.

It was so important to the state to educate people about the danger of losing your vote due to its nakedness that some PA state .

. If their goal was to reduce naked ballots, they failed miserably. If their goal was to create a clog in our electoral process that would result in mass instability, they succeeded with flying colors.

Intent Doesn’t Matter To The Law, Or Election Results

Whether they intended to defraud millions of people of their vote, it looks like that might be what they did. Without both envelopes, we can’t know if the votes were cast legally. I don’t think there is any way to get them back.

So the way I see it, there are two options: a new election, or toss mail-ins.

Ultimately, I believe it will be up to the Supreme Court to decide.

Personally, I believe the state needs a new election.

But, throwing them out is a more likely scenario.
